Employer Terms of Service

Service Provider: MB Rinkis Darbą, Vilnius, Lithuania

1. Service Description

The RINKIS DARBĄ Employer Service (hereinafter "Service") provides registered and approved employers and recruitment agencies (hereinafter "Employers") with access to the anonymized Talent Pool database. The Service allows searching for candidates by professional criteria, viewing anonymized profiles, and sending connect requests for specific job listings.

2. Registration and Approval

2.1. Employer account registration requires: company name, contact person's name, email address, and position title.

2.2. All Employer accounts must be approved by a RINKIS DARBĄ administrator before access to the Service is granted. The administrator reserves the right to reject registration without providing a reason.

2.3. By registering, the Employer confirms that they are authorized to act on behalf of their company or have company authorization to use the Service.

2.4. The Employer undertakes to provide accurate information about their company and contact details.

3. Service Plans and Limits

3.1. The Service is provided under paid plans with weekly limits:

3.2. Weekly limits reset every Monday at 00:00 UTC. Unused limits do not roll over.

3.3. RINKIS DARBĄ reserves the right to change plan pricing and limits with at least 30 days' notice via email.

4. Billing

4.1. Billing is based on monthly subscription according to the selected plan. Currently, payment is made via bank transfer based on an issued invoice.

4.2. The subscription period begins from the date of administrator approval or from the date specified on the invoice.

4.3. The subscription may be terminated at any time. Upon termination, access remains until the end of the paid period. No refunds are issued for unused periods.

5. Connect Request Rules

5.1. Each connect request must be linked to a specific job listing from the RINKIS DARBĄ database. Free-form requests are not permitted.

5.2. The job listing referenced in the request must correspond to the Employer's actual hiring need.

5.3. A request is valid for 14 days. If the Candidate does not respond within this period, the request automatically expires.

5.4. After a decline or expiry, a 30-day cooldown period applies before sending a new request to the same Candidate for a different job listing.

5.5. Sending a repeat request to the same Candidate for the same job listing is prohibited.

6. Data Usage Restrictions

6.1. The Employer undertakes to use candidate data obtained through the Service ONLY for:

  • Direct contact with the Candidate regarding the specific job listing
  • Further recruitment process with the Candidate's consent

6.2. The Employer is PROHIBITED from:

  • Transferring, selling, or sharing candidate contact details with third parties
  • Using obtained data for marketing purposes unrelated to the specific job listing
  • Mass collecting anonymized profile data
  • Systematically copying or reproducing anonymized profile data
  • Sending requests for non-existent or fictitious job positions

6.3. Candidate contact details received after acceptance become personal data processed by the Employer under GDPR.

7. Prohibited Actions

7.1. The Employer is prohibited from:

  • Attempting to identify a Candidate from anonymized profile data
  • Sending misleading, discriminatory, or improperly presented requests
  • Using automated means to access the Service
  • Sharing account credentials with other individuals
  • Using the Service for purposes that violate Lithuanian or EU law

8. Account Suspension and Termination

8.1. RINKIS DARBĄ reserves the right to suspend or terminate an Employer account at any time due to violation of these terms, abuse, candidate complaints, or unpaid subscription.

8.2. Upon suspension, the Employer loses access to the Service, but previously accepted connect requests remain valid.

8.3. The Employer may terminate their account at any time by contacting info@rinkisdarba.lt.

9. Limitation of Liability

9.1. RINKIS DARBĄ does not guarantee accuracy of candidate profiles, responses to requests, successful hiring outcomes, or a minimum number of candidates.

9.2. The Service is provided "as is." RINKIS DARBĄ's liability is limited to the current month's subscription fee.

9.3. RINKIS DARBĄ is not responsible for the accuracy or currency of data provided by Candidates.

10. Intellectual Property

10.1. The Talent Pool database structure, anonymized profile generation algorithms, match scoring, and aggregated data are the intellectual property of MB Rinkis Darbą.

10.2. The Employer acquires only the right to use the Service under these terms and does not acquire any rights to the database or its contents.

11. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of Lithuania. Disputes shall be resolved in the Vilnius City District Court.
